ADOPTION AGREEMENT
I, (We), _________________________________________________ the undersigned Adopter, (Hereinafter referred to as ADOPTER), agree to all the terms and conditions set forth within the pages of this adoption agreement as provided by the undersigned Giver, (Hereinafter referred to as GIVER), and confirm that the information provided in the associated Application for Adoption is complete and correct to the best of my (our) knowledge. We agree to these terms and provide an adoption fee of $____________ in order to adopt the pet, I hereby agree to the adoption fee to cover the current owner’s expense of raising and caring for the animal and is not refundable after a trial period of 14 days.

(Hereinafter referred to as PET). I, (We), understand that non-compliance with the terms and conditions of this agreement or misstatement of facts on the Application for Adoption grants GIVER the right to reclaim PET with no refund or recourse due ADOPTER.
This agreement will be in effect as of ___/___/___ and will continue until notification to GIVER, by ADOPTER of the death of PET. Such notification of death, or the repossession of PET by GIVER, or return of PET to GIVER (for any reason), shall be sufficient to terminate this agreement. All litigation, arbitration or other legal matters regarding this adoption are to be resolved under the appropriate legal office of and in the Province of Ontario. ADOPTER further agrees that should any such legal actions be resolved in favour of GIVER, ADOPTER will reimburse GIVER for attorney's fees and expenses incurred as a result of the dispute.
RELEASE of LIABILITY and INDEMNIFICATION
In consideration of allowing me/us to adopt this PET as a pet, I/We promise and agree to be solely responsible for this animal and to indemnify and hold harmless GIVER, affiliated organizations, volunteers and representatives from all claims of liability for the conduct of this PET on or after the date of this agreement. The undersigned(s) further agrees and intends that this RELEASE OF LIABILITY AND INDEMNIFICATION shall apply to all known, unknown, and unanticipated damages resulting from my/our adoption, ownership or control of such animal.
We have read and hereby agree to abide by all the TERM AND CONDITIONS of this ADOPTION AGREEMENT concerning the adoption of PET. THIS IS A BINDING CONTRACT, ENFORCEABLE BY CIVIL LAW.

Terms and Conditions of Adoption Agreement
(1) To return PET only
to GIVER it unable to keep. PET will be given 3 to 4 weeks to adjust to new
surroundings, in consideration of the fact that it takes this time period for an
animal to adjust to a new environment and for both PET and ADOPTER to adjust to
each other.
(2) To notify GIVER immediately by telephone if PET is lost or stolen and to
make every effort to locate the PET including placing advertisements in local
newspapers, notifying local law enforcement officials and regularly checking
local animal shelters and pounds for a period of two weeks.
(3) To never take PET to an animal shelter, pound or humane society for the
purpose of releasing ownership to such organization.
(4) To never allow to be used or to use PET in animal research.
(5) To never allow to be used or to use PET for fighting, fight training,
baiting or related activities whether legal or illegal in the place of
residence.
(6) To treat PET as a family pet, with affection and kindness and not subject
Pet to abuse or cruelty as defined by ADOPTER at any time.
(7) If PET is housed outdoors at any time, permanently or temporarily, it will
be in a six fool high chain link enclosure of at least ten foot by ten foot
dimensions with shelter from the elements, and with twenty-five percent (25%)
shade at all times, and will have high quality food (as defined below in this
agreement) daily and potable water available at all Times.
(8) To provide regular veterinary care, including annual vaccinations including
heartworm and rabies prevention and treatment, parasite checks and dental care.
(9) To provide proper food, shelter, fresh water, adequate companionship and a
fenced yard at all times, and to keep PET on a leash or in a crate when not on
Adopter’s property.
(10) To feed and maintain PET on a premium, meat and vegetable based dog food at
all times.
(11) To never transport PET in an open vehicle without proper restraint designed
specifically for this type of pet, (this practice is illegal in many states),
nor to in any way endanger the dog in similar fashion.
(12) To immediately license (dogs only), put and keep personal ID tag on PET
with an adequate and generally recognized safe, strong, collar and agree to
never leave a choke collar on the pet when unattended.
(13) To notify within 5 days it I (We) move and to provide new address and phone
numbers for work and home.
(14) ADOPTER agrees to allow GIVER representatives to periodically check on PET
to assure compliance with items #1 through #13 of this agreement.
ADOPTER ACKNOWLEDGES THAT GIVER HAS STATED THAT THIS PET HAS:

INFORMATION PROVIDED REGARDING TEMPERAMENT AND HEALTH IS BASED UPON KNOWLEDGE ACQUIRED DURING THE TIME THE DOG HAS BEEN UNDER THE CARE OF STRAY’S FARM, AND MAY NOT REFLECT FACTS NOT AVAILABLE TO THE GIVER AT THE TIME OF ADOPTION.
ADOPTER has been advised of these facts, understands the ramifications of such, and agrees to accept all responsibility for the behaviour and well-being of PET chosen for adoption while in their possession, and agrees to ALL CONDITIONS of this agreement.
